The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as "you") with Frankenstorm through Frankenstorm AB (org no: 559124-4404, VAT no: SE559124-440401), hereinafter referred to as "Frankenstorm", "us " or "we", at the Frankenstorm website, mobile website, or telephone (jointly referred to as "Frankenstorm.com").
By using Frankenstorm.com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the "Terms"). Please make sure you have read and understood the Terms before placing your order.
Only persons of legal age, 18 years or older, who are not under guardianship, and are not acting in capacity as a company, with a physical address in Sweden, excluding mail forwarding companies, can place an order.
Frankenstorm and its distributor reserves the right to restrict different areas for delivery during certain times of the year. The inclusion of any products or services on Frankenstorm.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.
We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms on frankenstorm.com at the time you place your order and will be valid for that specific purchase.
Frankenstorm want to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the frankenstorm.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.
2. PRICES AND DELIVERY CHARGES
The prices displayed at Frankenstorm.com include the statutory Value Added Tax. Frankenstorm offer free shipping. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries.
Occasionally, we may provide special offers and discounts relating to certain products on the Site. The conditions of use relating to any special offer or discount will be specified at the time of issue. We reserve the right to withdraw such special offers or discounts at any time, without warning.
FOR PERSONALIZED PRODUCTS
There is no legal return right for personalized products and given that we cannot sell a personalized product to another person we do not offer cash refunds. Unsatisfied customers can get 70% of the order value on returned products in a discountl code that can be used on Frankenstorm.com delivered to you by the same email as your order confirmation have been sent to. Customers are obliged to state reason for returning product in return sheet that follows the product. You will find the full Returns Policy at Frankenstorm.com/shipping-returns
FOR NON-PERSONALIZED PRODUCTS
You may cancel or return your order from the date you place the order until 30 days after receipt of the ordered items for non-personalized products. If you have been charged for the items, you will receive a refund.
Frankenstorm offer free return shipping for both personalized and non-personalized products.
If you wish to cancel or return your order, use the pre-printed return form in your parcel and return the item(s) to address: Frankenstorm AB, Energigatan 19, 434 37 Kungsbacka, Sweden within the 30 day period. We will provide a refund attempting to utilize the same method used to make the payment (or, if the items have not yet been paid for, reflect the return of the items in your account balance) as soon as possible and at the latest within 14 days of receiving your notice of cancellation, provided we have received the returning items. Another payment method may be used for the refund, provided that you consent to such a change; in any case this will not generate any additional charges. 4. QUALITY GUARANTEE
We take quality very seriously. If the item you have received is defective, please send a photo and description of the quality problem along with your name and order number to firstname.lastname@example.org. Please use subject: Quality problem, Order no: XX. Frankenstorm will, for any products deemed defective, provide a full refund, including the costs of delivery and return. The provisions set forth herein do not limit any applicable statutory rights.
In the event of an error in connection with any products or services displayed through frankenstorm.com (including typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability), Frankenstorm reserves the right to cancel any order prior to the time it is delivered to you.
5. ORDERING/CONCLUSUION OF CONTRACT
When placing an order at Frankenstorm.com it is a conclusion of a contract with Frankenstorm based on these terms and conditions.
The ordering options available to you are via Frankenstorm.com or by email. Please visit Frankenstorm.com/customer service for further information.
Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation.
If you want to order a larger bulk of products this can be made via e-mail, please send an e-mail to email@example.com specifying your request.
If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary we will notify you and ask you to contact Frankenstorm Customer Service at firstname.lastname@example.org who will settle the refund. Any order must total at least 50 SEK (after deduction of discounts) in order to be processed.
Before you place your order, you will be informed of the expected delivery details. Once you have placed your order you will receive an email or messenger confirmation (depending on your choice of communication media) with your expected delivery details. We aim to deliver within 4 to 5 working days following confirmation of an order unless otherwise agreed
Frankenstorm exercises the utmost diligence in accepting and processing orders and will endeavor to deliver your order in accordance with your selected delivery option and in the fastest possible time. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. Delivery will be conducted by a shipment service provider chosen by Frankenstorm. In the unlikely event the delivery time exceeds 20 days, you may cancel your order. If you have not received your order, please contact us at email@example.com.
On rare occasions, packages are returned to us as undeliverable. Frankenstorm shall promptly connect with the customers through email to understand reason and solve the delivery problem. If no answer within 14 days or if undelivered package the second time, Frankenstorm claims the right to the product. In an effort to reduce the impact of returned products and care about the mother earth, Frankenstorm returns the right to donate or recycle any returned or undelivered items as deemed appropriate in its sole discretion.
7. PAYMENT METHODS
You can pay for your goods in various ways as presented in the check-out section. The applicable amount will immediately be reserved on your credit/payment card but will not be debited until the goods are dispatched. Our partner Klarna will perform a validity check of the information provided and may refuse the order depending on the result.
You are obliged to submit a correct e-mail address and to inform Frankenstorm if your e-mail address changes. Please note that Frankenstorm reserves the right to send payment requests to your e-mail address.
You will receive the legally required invoice in the shipping confirmation e-mail.
8. LIMITATIONS OF LIABILITY
Nothing in these Terms shall exclude or limit Frankenstorm's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
Frankenstorm is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order on Frankenstorm.com shall be limited to the total price of your order.
Frankenstorm is solely a provider of the platform where customers can make their own personalized products for personal use. Frankenstorm takes no responsibility for content created by users.
9. YOUR ACCOUNT
Your saved designs will be removed after 30 days.
We make all reasonable efforts to accurately display the attributes of our products, including composition and colors. The color you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colors. For more information mail us at firstname.lastname@example.org.
Frankenstorm reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.
If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.
13. OWNERSHIP OF RIGHTS
All intellectual property rights, such as Frankenstorm related trademarks and copyrights at Frankenstorm.com remain with Frankenstorm AB and its subsidiaries or licensors. Any use of Frankenstorm.com or its contents, including copying or storing such content in whole or part, other than creating your personalized product for your own personal, non-commercial use, is prohibited without the permission of Frankenstorm.

We take all complaints very seriously and try to resolve disputes as soon as they arise. Customers wishing to make a complaint are encouraged to contact our customer care team as soon as possible at email@example.com.

4. WHAT DATA DO YOU COLLECT AND WHEN?
We collect your personal data in the following situations:
When you shop at Frankenstorm.com. When you purchase a product at Frankenstorm.com you need to provide your name, e-mail, address and phone number in order for us to deliver your products and also to stop and prevent fraud (as well as for investigation of such). We will also store information regarding your purchases, order history and, if applicable, returns and claims. When you shop without a customer account you receive a unique customer identification number.
When your sign up for our newsletter. When you sign up for our newsletter you need to submit your e-mail. When you sign up for our newsletter you will receive a unique customer identification number.
When you apply for invoice. When you apply to pay by invoice a credit check will be done and sometimes also a credit score. This will be done by Frankenstorm's partners that are controllers for such personal data provided by Frankenstorm. To complete the credit check you will need to leave your personal identification number.

Personal data transmitted to our service providers may only be used of them for their fulfilment of their services.

10. HOW WE PROTECT YOUR PERSONAL DATA
We have taken appropriate security measures to protect your personal data from loss, change or unauthorised access. We are continuously improving our security measures in line with progress and developments in the technical field.
To make purchases by credit card as safe as possible, all information is transmitted encrypted. This means that all information is transmitted via a safe connection and that your personal data cannot be read by a third party. For card payments we work with payment service providers who help us to control with your bank that your card is valid for purchase. Our payment service provider processes your card details in accordance with the international security standard PCI DSS. Therefore, your card details are processed with very high security. When you pay by card we reserve the right to perform an identity check.
12. HOW LONG WE WILL KEEP YOUR DATA
We will retain your data for as long as necessary in relation to the purposes for which it was collected. If you have not purchased (and have chosen not to receive any marketing) from us within a time period of 36 months, we will erase your customer data.
When your personal data is no longer necessary for the purposes for which they were collected, your personal data will be deleted or anonymised if there is no other legitimate reason of storing your data.
We will also retain your personal data as necessary to comply with applicable laws, to resolve disputes and to enforce our contracts.

In our offers to you by e-mail there is a direct link to use to terminate the merchandise. You can also log in to your customer account and edit how and if you want to receive merchandise (under "Edit profile").
If you would like to terminate your customer account at Frankenstorm.com you need to send an e-mail to hello@Frankenstorm.com. Your customer account will be deleted within 30 days and you will no longer have access to the personal data stored in the account. We will only retain personal data as necessary for other legitimate reasons, such as receivables or before we have fulfilled our contract with you, such as a purchase.
14. RIGHT TO COMPLAIN TO SUPERVISORY AUTHORITY
The Swedish Data Protection Authority is the supervisory authority for the processing of personal data in Sweden. If you consider our processing of your data to be in violation of applicable data protection laws, you have the right to lodge a complaint with the Swedish Data Protection Authority.
We can update this policy at any time. When we make changes, we will publish the last updated version at Frankenstorm.com and the changes will come into force on the publication date.
